Complaint by former supt.

Lawsuit filed against JCD

A civil lawsuit was filed in Ripley Superior Court by a former superintendent against Jac-Cen-Del School Corporation. Leanna Phillippe is seeking lost wages, benefits and investment income, and punitive damages from the school corporation as a result of being terminated. Phillippe was hired as the school superintendent and also signed a teacher’s contract around Feb. 15, 2012.

The contract was for three years, ending in June, 2015, but in May, 2014, the school board began termination procedures against her alleging insubordination, incompetence and “other good or just cause.” The complaint filed on Feb. 2 by Phillippe states the corporation failed to meet the standards outlined in state code to establish the grounds necessary to terminate her contract. She received a hearing before the school board to dispute the charges, but afterward the school board, acting for the corporation, ended her superintendent’s position and teacher contract.

The lawsuit states the former superintendent has been damaged by the improper and illegal termination of her contract by lost wages, benefits and retirement income. The complaint states the school board violated the state statute, and it also states “the collective action of the board was willful and malicious such that punitive damages should be awarded” to Phillippe. An amount was not listed. A copy of the complaint was sent by certified mail to the corporation. The corporation, which is represented by Doug Wilson, must respond within 23 days or judgment will be rendered. Phillippe’s attorney is John Watson. Prior to the superintendent role, Phillippe was principal of JCD Elementary.
